How is severance (liquidacion) calculated in Mexico?+

Severance for unjust dismissal includes: 3 months salary (Art. 48 LFT), 20 days per year worked (Art. 50 LFT), proportional Christmas bonus, proportional vacation, vacation premium, and seniority premium. The final settlement (finiquito) includes proportional benefits and applies in all termination types.

What's the difference between liquidacion and finiquito?+

Finiquito is the payment of proportional benefits received upon ending any employment relationship (resignation, dismissal, or mutual agreement). Liquidacion is an additional payment that only applies for unjust dismissal and includes the constitutional indemnity of 3 months and 20 days per year.

How many vacation days am I entitled to after the 2023 reform?+

With the January 2023 reform, the first year you're entitled to 12 days (previously 6). The second year is 14, third 16, and so on with 2-day increases up to 20 in the fifth year. From 6 to 10 years it's 22 days, then increases by 2 days every 5 years.

Does the calculator include taxes?+

No. This calculator shows gross legal amounts. Severance and final settlement have special tax treatment. Some items like the indemnity are partially exempt from ISR (income tax). Consult an accountant or attorney for net amounts.

What is the seniority premium (prima de antiguedad)?+

It's a benefit equal to 12 days of salary per year worked (Art. 162 LFT). The base salary for this calculation is capped at 2 times the minimum wage. It's paid in case of dismissal, and for resignation only if the worker has 15 or more years of seniority.
